Federal Court Orders Freedom of Abrego Garcia from Immigration Detention

A court has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without lawful basis.

"Since his return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.

The case originates in a erroneous removal to El Salvador in March, which the government later admitted was an error. After his return to the United States to answer alien smuggling charges, he was detained in federal detention.

In her decision, the court pointed out that the authorities lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
